WARNING:
ON OCTOBER 1, 2025 IT MUST BE COMPLIED IN FULL AND WITH THE 3 PHASES OF NOM-051-SCFI/SSA1-2010 establishes three phases for the labeling of prepackaged foods and non-alcoholic beverages in Mexico.
This applies to products intended for the final consumer (retail).
Confirm with the Verification Unit that your labeling is complete and complies with the 3 phases.
NOM-051-SCFI/SSA1-2010 establishes three phases for the labeling of prepackaged foods and non-alcoholic beverages in Mexico:
• Phase 1: It started on October 1, 2020, and lasted until September 30, 2023.
• Phase 2: Began on October 1, 2023, and was scheduled to end on September 30, 2025.
• Phase 3: Was scheduled to begin on October 1, 2025. Originally, Phase 3 was planned to begin in 2025.
In each phase, the seals are evaluated according to the following criteria:
• Phase 1
From October 1, 2020, to September 30, 2023 (3 YEARS), the calculation and evaluation of supplementary nutritional information will be conducted using the following criteria and values:
1. Critical nutrients added to prepackaged food or nonalcoholic beverages:
a) If added sugars are included, evaluate sugars and calories.
b) If fats are added, evaluate saturated fats, trans fats, and calories.
c) If sodium is added, evaluate only sodium.
2. Nutritional Profiles - Phase One.
• Phase 2
From October 1, 2023, to September 30, 2025 (2 YEARS), the calculation and evaluation of supplementary nutritional information will be conducted using the following criteria and values:
1. Critical nutrients added to prepackaged foods or non-alcoholic beverages:
a) If added sugars are present, sugars and calories must be evaluated.
b) If fats are added, saturated fats, trans fats, and calories must be evaluated.
c) If sodium is added, only sodium must be evaluated.
2. Table 6 of the amendment to the standard on Nutritional Profiles, which is reproduced below:
• Phase 3
Effective October 1, 2025, the calculation and evaluation of supplementary nutritional information will be conducted in full compliance with the provisions of Section 4.5.3 (Standard 051) and with Table 6 of the amendment to the standard regarding Nutritional Profiles.
1. Full Compliance: Ensure that all labeling requirements are met in accordance with the phases established in NOM-051-SCFI/SSA1-2010.
2. Evaluation Criteria: The five seals will be evaluated using criteria similar to those of Phase 2, with updated standards for supplementary nutritional information and new requirements for front-of-package warning labels.
Why is Phase 3 being postponed until 2028?
The postponement of Phase 3 until 2028 is based on a social, economic, and nutritional impact analysis. Mexican authorities acknowledged that applying the final criteria on the previously established dates could have had adverse effects, especially on staple foods.
Furthermore, it would have generated immediate economic pressure across entire production chains: from farmers and input suppliers to manufacturers, importers, distributors, and points of sale. The risk would not only be price increases but also potential shortages in certain sectors.
This postponement, far from relaxing the regulations, is a strategic opportunity that gives the industry more time to plan and implement the necessary changes to its processes and products.
